What is Power of Attorney?

A power of attorney (POA) is a legal document that allows another person access to manage your financial affairs on your behalf.
 

Why would I need this?

POA is often requested due to circumstances such as loss of mental capacity or a serious health condition. It can also be put in place for future planning, in case you become unable to manage your own affairs.

Having a POA in place means we can speak with the Attorney directly about your account or policy. It also means they can manage your account in a similar way you can, so they’ll be able to move money, check statements and update details, for example.

Whatever the reason you want to set up an Attorney on your account, we can help you do this.
 

There isn't a POA in place just now, what can I do in the short term while I get it set up?

We understand that there may be circumstances where you need to support a family member with their account, but you don’t have a POA in place. If you’re in this position and need our help, please call us. We’ll let you know what help we can offer in the short term, whilst you apply for longer term access.
 

Are there different types of POA?

Yes, different types of POA exist and can depend on factors such as your location and the level of access required.

How do I set up an Attorney on my account?

You need to have a legal POA document in place before you can register the Attorney on your account. Once you have this, we can help you get this registered.

I’m not a Sainsbury’s Bank customer. How do I open an account with my POA?

For Loans and Credit Cards you need to apply for an account in your own name first. Once your account is open, we can register an Attorney to help manage your account. If anything could affect your ability to understand the application, please call us. We'll be able to discuss your needs and offer suitable support.

For Savings accounts, please call us and we’ll help you get set up.

A legal POA document is needed before an Attorney can be registered on an account. Once you have this, we can help you get this registered.

How do I register an Attorney on my account?

We need you to send us the following:

  • The legal document e.g. a Power of Attorney – this must be the original document, or a certified copy
  • A registration form, which you can download here or alternatively you can contact us to send you one in the post
  • 2 pieces of identification for the Attorney (unless they are already an existing customer with us)

You can find out more about certified copies and what identification we accept here.

If you have a Lasting Power of Attorney (LPA) access code, we can use this to retrieve a copy of the legal documents, meaning that we don’t need this to be sent to us. Just add the LPA access code details to the registration form instead.

Can I have more than one person registered as an Attorney on my account?

No, we can only register one Attorney on an account, so you will need to decide who you want to operate the account. If your legal document states that there is "joint" access, the Attorney who is not operating the account will need to provide a letter confirming they’re happy for the other Attorney to act on your account without them.
 

Can I still access my account once I’ve registered an Attorney?

You’ll still be able to manage your account in line with the terms of the legal document granted. Normally, with an Attorney in place, you can still manage your account online and via phone unless there has been a specific request made to restrict that access. For example, a Court of Protection order where a Guardian has sole access and the account holder would be blocked from accessing their accounts.
 

What can my Attorney do on my account?

Your Attorney can do everything they’d need to manage your account. They can also open a new Savings account on your behalf, all they have to do is call us and we’ll complete a new application with them over the phone.
 

Who will receive correspondence about my account once I’ve registered an Attorney?

Once we’ve added your Attorney to your account, all correspondence including statements will be sent to them.
 

Can my Attorney access the account online?

Yes, we’ll link your account to their online portfolio once registered.
 

What happens if I pass away – can my Attorney still access my account?

No, once we are made aware that the account holder has passed, the Attorney status on the account will end. We will then only be able to discuss the account with the executors.
 

What if my circumstances have changed and I want to remove/change my Attorney?

For POA, we’ll need you to send us either:

  • A Deed of Revocation
  • A signed disclaimer from the Attorney, confirming they should be removed.

For Court of Protection orders we need to see the relevant court documents from the Attorney.

If a new Attorney is to be registered, a registration form will need to be completed by them. This can be downloaded here, or they can contact us, and we’ll send a copy of the form in the post.

I’m an Attorney for an account holder, how do I register this?

We need you to send us the following:

  • The legal document e.g. a Power of Attorney – this must be the original document, or a certified copy
  • A registration form, which you can download here or alternatively you can contact us to send you one in the post
  • 2 pieces of identification (unless you’re already an existing customer with us)

Yes, we’ll link your account to their online portfolio once registered.
